European Patents shall be granted for any inventions which are new, which involve an inventive step and which are susceptible of industrial application. Inventions must have a technical character.

The proceeding is held in European Patent Office (EPO) in Munich. We can represent the applications.

Stages of the proceeding

1st stage: Filing application – usually in English but can be also in German or French.

2nd stage: Receiving official search report – analyzation of the standpoint of the Examiner to the novelty and inventive step. Evaluation of chances for the further proceedings.

3rd stage: Full examination – adapting of the text if necessary, explanation if something not clear enough.

4th stage: Grant – receiving Certificate.

5th stage: validation in Counries of Interest among European Patent Convention (EPC) countries: AL, AT, BE, BG, CH, CY, CZ, DE, DK, EE, ES, FI, FR, GB, GR, HR, HU, IE, IS, IT, LI, LT, LU, LV, MC, MK, MT, NL, NO, PL, PT, RO, RS, SE, SI, SK, SM, TR.

Unified Patent

Or for EU states adopting Unified Patent System  Unified Patent can be applied (no individual validations in countries).

The proceeding usualy takes 2-3 years.

The validity of the patent is 20 years since the filing date and is subject to the payment of annual maintenance fees.
